Judge Upholds $5.1 Million Verdict in Subrogation Dispute

A San Francisco trial judge last week upheld a $5.1 million jury verdict in favor of a comp carrier and an injured worker on a subrogation claim against an asbestos abatement contractor. The SeaBright Insurance Co. and David Melanson also received an award of $486,810.16 in costs, and the carrier is getting an additional $10,000 in attorney fees from LVI Environmental Services.LVI had been the asbestos abatement and demolition contractor on a remodeling project for the San Francisco VA Hospital in July 2007.
