Why Settle Rehab Out for Just Pennies on the Dollar? DWC Form RU-122

When an injured worker (IW) with a date of injury prior to 2004 is not interested in going to school to enhance their employability, you may want to ask if s/he has thought about starting a small business. If so, the RU-122 can help.

The first step is to refer the case to a Qualified Rehabilitation Representative (QRR) who will perform an evaluation and develop a Self-Employment Plan. The QRR will then request, from the insurance carrier, the services of a professional business consultant who will create an Advisability/Viability-Analysis Report for the injured worker's Self-Employment Plan.

The business plan will identify a business that combines your client's interests, training, and background while considering their financial requirements and medical restrictions. A marketing plan is also developed to guide the worker to future growth and eventual success and independence.

In my experience the benefits of this route can surpass the usual rehabilitation. Although the IW often comes into the process with a pessimistic attitude, by the time the initial meeting is over s/he has often gained a higher degree of self-respect and renewed hope for the future.

If this sounds like it might be beneficial for your client, I recommend having them follow up with a government sponsored outreach agency such as Small Business Development Center (SBDC), at www,sbdc.org. The IW qualifies for free professional business consulting and workshops as a start-up owner. The IW will also be given assistance in obtaining a business start-up loan such as a Small Business Administration (SBA) micro loan and/or a minority loan.

Every one wins with the RU-122. Within one week from the meeting the plan and report are delivered. The applicant attorney has cost documentation for negotiation purposes. The 8 to 10 page analysis report contains a pro-forma spreadsheet, financial requirements, and other pertinent information. The insurance carrier has closure with no further exposure. The injured worker has a new career path and a larger settlement enabling ownership of a small business and a better quality of life.
