Outside of settlements, claimants' and insurance attorneys say they don't agree on much. But in West Virginia, both sides are raising questions about a bill that would revamp the workers' compensation court system.
“From my perspective, the system is about as efficient as you're going to find and there's no need to eliminate the administrative law judges that we have now,” said Jeffrey Brannon, a defense attorney in Charleston. “There's a significant amount of institutional knowledge that could be lost.”
