1st DCA Rules EMA Fees Are Capped at $200 for Deposition Testimony

The Florida 1st District Court of Appeal on Tuesday ruled that the maximum fee an expert medical adviser can receive for his deposition testimony is $200 per hour. The Florida Division of Workers’ Compensation has proposed bumping the maximum up to $300 in order to bolster the state’s thin roster of EMAs – but that's still far below the $750 per hour that Dr. Richard Rozencwaig had been demanding. Florida Statutes Section 440.13(10) provides that "(a)ny health care provider who gives a deposition shall be allowed a witness fee," which "may not exceed $200...
