The Kentucky Department of Workers’ Claims on Tuesday announced that it will allow court reporters to take depositions while not in the presence of the person being deposed during the ongoing COVID-19 outbreak.
The DWC said it will suspend a rule — 803 KAR 25:010 Section 17(2) — that outlines when depositions can be done over the telephone.
The rule allows telephonic depositions if the court reporter administering the oath and recording the proceedings is physically present with the witness.
