Injured workers in Oregon who insist on receiving brand-name drugs when the prescribing physician didn't prohibit generic substitution will have to cover the cost difference under rules that go into effect April 1.
Revised changes to Oregon Administrative Rules 436-009 adopted by the Workers' Compensation Division would require the carrier to inform the worker of the liability for covering the difference in cost between the brand-name and generic drug before the worker could be forced to make a payment.
