A California appellate court upheld the dismissal of a self-represented worker’s claims against the qualified medical evaluator whose report provided the basis for the denial of her workers’ compensation claim for a psychological injury.
The court said Samreen Riaz failed to oppose a demurrer to her complaint. But even without this fatal error, her civil case was nonetheless doomed because workers' compensation is the exclsuive remedy for injuries stemming from conduct occurring in the claims process.
