State Compensation Insurance Fund added information to its website to help employers determine how to classify their workers under California’s new employee status test.
Gov. Gavin Newsom in October signed Assembly Bill 5 codifying the ABC test from the state Supreme Court’s 2018 Dynamex decision. The test presumes workers are employees unless the employer proves the person is free from control and direction, is doing something outside the usual course of business for the hiring entity and is customarily engaged in an independently established trade.
