A New York appellate court upheld the dismissal of a worker’s civil suit against a co-employee who truck him with a truck while running an errand.

Facts: James Jones worked as a security guard at the New York Botanical Gardens. On Aug. 10, 2017, he was struck by a pickup owned by Kaleidoscope Garden Design LLC and operated by Toby Adams.
Adams was employed by the NYBG and was on his way to pick up food for the gardens' pet rabbit. Jones received workers’ compensation benefits for his injuries.
