The National Council on Compensation Insurance is not a public agency and does not perform government functions and, therefore, is not subject to the state’s Sunshine Law, the Florida Office of Insurance Regulation argues in a reply brief filed late Thursday.
The brief was filed as part of its appeal in the 1st District Court of Appeal to a Nov. 23 circuit court ruling in favor of Miami claimants’ attorney James F. Fee Jr., who alleges NCCI and FLOIR colluded in secret to settle on a 14.5% increase in workers’ compensation rates.
