A New York appellate court ruled that a worker was entitled to summary judgment on his Labor Law claim for injuries from being struck by a falling piece of metal.

Facts: Sterling Miller worked for J&E Pile Driving Inc. as a laborer. Miller rigged a metal "Z sheet" to a crane and signaled the operator to hoist it even though a 600-pound metal "corner piece" was lying unsecured on top.
As the crane was hoisting the Z sheet, the corner piece fell and struck Miller on the head.
