An adage says bad luck supposedly comes in threes, and that held true Wednesday when the Oregon Court of Appeals overturned the state Workers' Compensation Board in three separate cases.
In Scott v. Liberty Northwest, the court said the board should have issued an award of attorney fees to the claimant for a carrier's failure to pay benefits because the facts clearly showed the claim should have been paid.
The problem in Williams v. SAIF Corp., according to the court, was that the board actually made erroneous factual findings.
