The New York Court of Appeal last week announced that it will weigh a dispute over the proper calculation of an injured worker’s schedule loss of use award where he suffered separate injuries that both affected his use of his left arm.
The case is Liuni v. Gander Mountain, Motion No: 2020-911.
In November, the Appellate Division’s 3rd Department ruled that Joseph Liuni was not eligible for separate SLU awards for an injury to his left bicep and a later injury to his left shoulder, since both conditions were encompassed by SLU awards for the left arm.
