A New York appellate court upheld the denial of a schedule loss of use award for a worker’s shoulder injury. Case: Matter of James v. Premier Home Health Care, No. CV-23-1674, 11/14/2024, published. Facts: Juana James worked for Premier Home Health Care. She established a claim for an injury to her left shoulder. A magnetic resonance imaging scan ruled out a rotator cuff tear.
