The North Carolina Court of Appeals on Tuesday ruled that a group of 17 workers suffering from the effects of their industrial exposure to asbestos effectively have no legal remedy available to them since their formerly self-insured employer is bankrupt and the state's Self-Insurance Security Association does not have to cover their claims.
The association was formed in 1986, after a spate of self-insured trucking companies went under and left several injured employees with no means to get paid for their workers' compensation claims.
