A narrowly divided Washington Supreme Court on Thursday ruled that the estate of a long-time Boeing employee who died from mesothelioma could not pursue a civil suit against his employer under the deliberate intention exemption to the Industrial Insurance Act.
This decision is at odds with recent decisions from Illinois, Pennsylvania and Virginia, where courts have let workers with industrial asbestos-related injuries go outside the workers' compensation scheme to seek redress.
