Montana’s workers’ compensation law says that an employee is not eligible for workers’ compensation benefits if the use of medical marijuana is the major contributing cause of the injury or the occupational disease.
But many other state workers’ comp laws don’t explicitly address the use of medical marijuana on the job — although many restrict workers’ compensation benefits when an injury is attributed to intoxication or drug use, according to a new report from the National Council on Compensation Insurance.
