Demolition Worker Gets Summary Judgment on Labor Law Claim

A New York appellate court ruled that a demolition worker was entitled to summary judgment for his Labor Law claim from being knocked off a scaffold after being struck by a falling slab of concrete. Case: Mena v. 485 Seventh Avenue Associates LLC, No. 20345/17E, 11/04/2021, published. Facts: Edwin Mena allegedly suffered injuries while performing demolition work. He claimed he was using a motorized chipping hammer to remove part of a wall directly adjacent to the ceiling when a concrete slab from above collapsed on him, knocking him off a scaffold and onto the ground about 6 feet below....
