A bill awaiting a vote in the Alabama Senate would limit permanent and total disability benefits to 500 weeks or until the claimant reaches ages 65, whichever is later.
Senate Bill 122 by Arthur Orr, R-Decatur, would also create a rebuttable presumption that if a claimant does not receive medical treatment for an injury for a period of two years, that any subsequent treatment is not related to the work injury. The bill also would end all employer liability for medical treatment if the claimant does not receive medical treatment for a claimed injury for a period of four years.
