The state is entitled to a credit for payments it made voluntarily before a workers' compensation court judge ordered indemnity benefits to a woman exposed to chemicals on the job, the Nebraska Supreme Court ruled last week.
"The state was entitled to credit for the voluntary payments it made before the award was entered, and the Workers' Compensation Court did not err in admitting the State's evidence and denying the (claimant's) motion for a waiting-time penalty and attorney fees," the justices decided in D'Quaix v.
