Court Upholds Dismissal of Widow's Claim against Car Dealership

An Illinois man killed by a moving garage door was a borrowed employee of the car dealership where his fatal accident took place, which means his widow cannot bring a tort claim against the business, the state appellate court ruled last week. As a result, a District 1 panel concluded that worker's compensation exclusivity barred his widow's tort claims based on his death. The case was Prodanic v. Grossinger City Autocorp, No. 09 L 258.
