Legislation introduced in advance of the 60-day session starting Jan. 21 would require New Mexico employers to advance more money to injured workers for discovery and increase the cap on attorney fees.
Though New Mexico law declares that the costs of discovery shall be borne by the party requesting it, employers must advance the cost of paying for discovery requested by injured workers. Discovery costs are paid by the employer if the injured worker prevails and must be reimbursed if the claimant does not prevail.
