The bill to codify the California Supreme Court decision in Dynamex and require the use of the so-called “ABC test” to determine who is an employee and who is a contractor moved one step closer to the governor’s desk.
The Senate Labor, Public Employment and Retirement Committee on Wednesday voted 4-1 to pass Assembly Bill 5, by Assemblywoman Lorena Gonzalez, D-San Diego. In general, the bill would expand the application of the April 2018 high court decision to all Labor Code and unemployment cases where there is a question of employee status.
