Court Dismisses Allegations of Rx Kickback Scheme

A federal court in Florida granted a U.S. Attorney’s Office request to dismiss charges filed in 2022 accusing two pharmacy executives of conspiring to solicit kickbacks as part of an in-office drug dispensing program.

The U.S. District Court for the Middle District of Florida on Sept. 14 dismissed without prejudice charges against Thomas Mollick and Martin Krytus. The U.S. Attorney’s Office on Sept. 14 asked the court to dismiss the case.

The U.S. Attorney’s Office in 2022 announced an indictment against Mollick, the founder and president of Rx Development Associates in Seminole County, and Krytus, a co-founder and vice president of the company that provided medication dispensing management services to doctors as part of an in-office drug program.

The indictment alleged that the pair solicited kickbacks on medications they ordered from a drug wholesaler in California.
