A divided Florida Supreme Court ruled that a third-party tortfeasor formed a settlement contract with an injured worker by accepting the proposal in writing, within the time frame the worker allowed.
The majority said the fact that the third party modified the terms of the proposed settlement, and the injured worker did not accept them, was irrelevant. A dissenting judge opined that there was no enforceable settlement contract, since the parties had not agreed on terms of the deal.
