The Kentucky Court of Appeals surprised both sides last week when it struck down a key provision of a sweeping workers’ compensation reform law, basing its ruling on a quirk in the legislative process that wasn’t even mentioned in legal arguments of the case.
“This is clearly an erroneous ruling and I expect it to be overturned at the Supreme Court,” said state Rep. Adam Koenig, R-Erlanger, who sponsored House Bill 2 and shepherded it through the General Assembly last spring.
