An employer effectively admitted that a fast-food restaurant worker who was raped while on the job was entitled to the maximum rate of permanent partial disability compensation by failing to timely respond to her claim that she was entitled to the maximum, the Missouri Court of Appeals ruled.The appellate court overturned a ruling by the state Labor and Industrial Relations Commission that the claimant, identified only by her initials T.H., was entitled to the minimum rate of only $40 a week for the psychological injuries she suffered from the sexual assault.
