AUSTIN, Texas -- A state district judge on Monday rejected an attempt to dismiss a lawsuit challenging the authority of Texas chiropractors to perform clinical needle electromyography (EMG) and manipulation under anesthesia (MUA). A trial in the dispute is expected to be set for next summer.
Judge Stephen Yelenosky of the 345th District Court rejected contentions by an assistant attorney general representing the Board of Chiropractic Examiners that the controversy was “not ripe” for consideration because the board has not adopted a final rule regarding the procedures.
