Injured workers in New Mexico could have their indemnity benefits reduced if a post-accident test reveals a blood-alcohol concentration of as low as 0.02%, under rules proposed by the Workers’ Compensation Administration.
The WCA is proposing the rules to implement Senate Bill 214, a bill passed this year allowing judges to reduce benefits by 10% to 90% based on the extent to which drug or alcohol use contributed to an accident.
