AUSTIN, Texas -- A Travis County district judge has notified attorneys that he intends to invalidate the hearing process that the state Division of Workers' Compensation uses to resolve disputes over payment of long-pending medical fee disputes involving hundreds of hospitals and thousands of claims.
Judge Stephen Yelenosky sent a letter opinion Wednesday to attorneys for parties in the lawsuit reporting that he had concluded the process had denied the hospitals due process and that the statute relied on by the division in the dispute resolution process was "facially unconstitutional."
