The Minnesota Court of Appeals yesterday
affirmed the decision of district court Judge Gary Larson in the action
brought by Korey Stringer's family against three Viking athletic trainers. In
their suit, the Stringer family asserted that the three trainers were grossly
negligent in their care of Stringer when he experienced heat stroke during
practice on August 1, 2002. The Court of Appeals held that workers'
compensation benefits were all that the family could recover due to the
exclusive remedy provision of the statute.
