The Court of Appeals of Virginia affirmed a challenge by Fairfax Hospital and its insurer, Inova Health System Foundation, to the Virginia Workers' Compensation Commission, which issued a split decision in a case involving an injured employee who found employment elsewhere.
The court agreed with the appellants "on the ground that the commission's decision rests on insufficient evidence," according to the ruling.
The case was Fairfax Hospital v. McKaveney 2741-06-4, 10/02/2007.
