CA 2nd Rules SB 899 5814 is Retroactive

The Second Appellate District of the California Courts of Appeal ruled yesterday that Labor Code section 5814 as amended by SB 899 became applicable to all injures in then pending cases as of 6/1/04.In Green vs. WCAB (B171921, 3/30/05) Green claimed orthopedic, psychiatric and internal work injuries from 1987 to May 30, 2000, and additional orthopedic injuries on February 14, 1994, and January 1, 1997.
