USCA 1st: Merger Succesor's Benefit Payment Precludes Tort Suit

The United States Court of Appeals for the First Circuit ruled that a worker's tort claim is barred where workers' compensation benefits have been paid by a merger successor. In Braga v. Genlyte Group, Inc., No. 04-2429, 08/25/2005, Antonio Braga injured his hand in a hydraulic press accident while working for Genlyte-Thomas Group, LLC (Genlyte-Thomas).
