An executive who was aboard the jetliner that hijackers crashed into the Pentagon on Sept. 11, 2001, didn't qualify for workers' compensation death benefits because his company employed too few people, the Virginia Supreme Court ruled.
The justices issued their decision in the 9/11 death claim filed by the family of Richard Gabriel, a co-founder of a business consulting service incorporated in 1999 in Virginia. Gabriel was traveling on business for the company on Sept. 11, 2001, when his flight was hijacked by terrorists and flown into the Pentagon.
