The California Supreme Court, in what has become a customary action of late, has agreed to hear a fifth apportionment case, but only after disposing of the Welcher and Brodie cases ahead of it.
The court reported this week that it granted writ in Chevron v. WCAB (Lee), case nos. S148819 and A115284.
An Oakland trial judge apportioned a permanent disability award to Chevron employee Serina Lee, using the dollar method in Dykes. Chevron sought reconsideration of the decision and the Workers' Compensation Appeals Board denied. The 1st District Court of Appeal also denied.
