The California Supreme Court after weeks of granting workers' compensation case reviews turned down a pair of recent high-profile opinions, including one that defined substantial evidence for apportionment of disability.
The justices refused to take up Yeager Construction v. WCAB, E038699, 11/28/2007, the apportionment-evidence decision by the 4th District Court of Appeal. That court -- in an opinion certified for publication -- reversed a trial court and the board and apportioned an award because the injured construction worker had a pre-existing spine condition before a job site fall.
