A representative of the Vermont Workers' Compensation and Safety Division (WCSD)issued a clarification to stakeholders regarding apparent confusion over the 90 day-notice rule and vocational rehabilitation (VR) referrals.
VR specialist Trudy Smith, in an e-mail, noted that when a claimant has been out of work for 90 days on temporary total disability (TTD) "you must notify the department."
However, Smith noted, "you can refer a claimant to VR at any point in time."
