The Third District of the California Court of Appeals ruled that the Fair Employment and Housing Act (FEHA) does not preclude employers from firing or not hiring a person who uses illegal drugs. In Ross v. Raginwire Telecommunications, Inc., No. C043392, 09/07/2005, Gary Ross, who suffers from chronic back pain and is a qualified individual with a disability as defined by FEHA, uses marijuana to ease his back pain.
