Hay Truck Driver Deemed Special Employee of Farm

The California 3rd District Court of Appeal ruled Tuesday in an unpublished opinion that a hay truck driver was the special employee of a farm and not a labor contractor who carried the man on his payroll. The court held that the driver's sole remedy for the industrial accident is workers' compensation. Struck while adjusting load Emilio Morales Zavala, identified by the court as Morales, was adjusting a load of hay when he was struck by a vehicle.
