A Pennsylvania appellate court told a city contesting a penalty that documents not admitted into evidence at the trial can't be considered in the appeal.
The city of Philadelphia argued that it had paid the disability benefit to its injured police officer, and that the judge erred in assessing a 50% penalty for the unpaid amount for wage loss.
The Commonwealth Court, however, rejected the city's evidence to support that it paid injury-on-duty (IOD) benefits to police officer Joseph Cosgrove before a workers' compensation judge assessed 50% penalty on unpaid compensation.
