The California Supreme Court refused to hear a seasonal agricultural worker's appeal for year-round temporary disability payments.
The court on Wednesday denied Eva Ochoa's petition for review of a decision by the 5th District Court of Appeal. That court overturned the Workers' Compensation Appeals Board's decision to continue her temporary disability payments while she was furloughed for the season.
Signature Fruit Co. of Modesto argued that a seasonal employee is not entitled to temporary disability payments during the season when he or she is out of the labor market.
