The Montana Workers' Compensation Court has turned down $200,000 in vocational rehabilitation benefits for a paraplegic pilot who wanted more flying time so he could seek flying contracts with the State of Montana and United States Forest Service.
In a March 2 decision, the court ruled in Jonathan Lion vs. Montana State Fund, 2005 MTWCC 11, WCC No. 2004-1093 that applicant Jonathan Lion was not entitled to additional voc rehab benefits after failing to find a job as a commercial pilot. The court denied the petition on the grounds that:
