California's Second District Court of Appeals Thursday, in an opinion not certified for publication, reversed a WCAB award for discrimination where the injured worker failed to show that the employer singled him out for disparate treatment.In County of San Luis Obispo vs. WCAB (Martinez), B182145 (09/29/05), Art Martinez sustained industrial injury to numerous body parts, including his neck, spine, wrist and shoulder, on February 24, 2000, while working as a mental health therapist in the homeless outreach program for the County.
