Trial Judge Declares Another Provision of 2013 Reforms Unconstitutional

A state trial judge this week declared another potion of the 2013 legislation to overhaul the Oklahoma workers' compensation system unconstitutional, according to claimants' attorney Bob Burke. Grady County District Judge Richard Van Dyck on Monday struck down a provision of the 2013 legislation that granted employers and carriers a right of subrogation if a worker's family were able to recover from a third-party in a wrongful death case.
