The Commonwealth Court of Pennsylvania ruled that a pension offset is not available when the retiree returns to work for a former employer on a part-time basis and suffers an injury in the course of the new round of employment.
Paul Pasko worked for Bradford County for 25 years. When he retired, Pasko withdrew a lump sum from his employer-funded pension and began receiving a monthly pension benefit of $1,668.23.
Pasko later returned to work for the county on a per diem basis for 16-20 hours per week.
