The National Labor Relations Board has withdrawn a 2023 standard for determining whether two entities are joint employers of a particular worker, replacing it with a standard from 2020, according to a notice in the Federal Register.
The board in October 2023 proposed a rule allowing indirect and reserved control over terms of employment, including wages, benefits, hours, hiring and supervision, to be sufficient to establish joint-employer status.
