A trial court improperly dismissed an injured worker’s lawsuit against her co-worker for alleged negligence by failing to draw a distinction between an employer’s duty to provide a safe workplace and the co-workers’ independent duty to show proper care, the Missouri Eastern District Court of Appeals ruled.
