2nd Appeals Ct. Finds no Exclusive Remedy for Occ. Disease Claims

A second Missouri appellate court has ruled that occupational diseases suffered by employees after 2005 amendments to the Workers' Compensation Act are not protected by exclusive remedy, clearing the way for civil suits against employers who fail to protect workers from toxic substances. The Missouri Eastern District Court of Appeals on Tuesday reversed a trial court's order to dismiss a lawsuit filed by former workers of a popcorn plant who say their lungs were damaged by exposure to diacetyl, a chemical often used in the manufacturing of artificial butter-flavored popcorn.
