A New York appellate court denied a plaintiff's and third-party defendant's motions for summary judgment in a civil suit, after determining that triable issues of fact existed regarding both parties' liability.The case, Boston v City of New York, No. 2007-05949, 5/9/08, stems from a sanitation worker's injuries that he suffered while collecting trash for his employer, the City of New York.
